TERMS & CONDITIONS
By accepting our quotation you also agree to the Terms and Conditions set out below. If you have any questions or concerns, please don’t hesitate to call us on 0118 370 2060.
Acceptance
1. By accepting our quotation you agree to these Terms and Conditions. Acceptance may occur by signed acceptance, purchase order, subcontract order, email instruction, programme instruction, site commencement, payment of a deposit, or by permitting Screed Works Ltd to proceed with the Works.
Your quote
2. Our quotations are based on the information available to us at the time of preparation. The final invoice may be subject to change due to variations in final depths, area measurements or site conditions; however, we will endeavour to alert you to any such changes as soon as we become aware of them.
3. The quotation is open for acceptance for 2 months.
4. Unless otherwise agreed, a deposit equal to 50% of the total quoted price is required to fully accept the quotation.
5. Unless otherwise stated, the quotation includes all labour, plant and materials.
6. The quotation is based on full, unrestricted and continuous access to sufficient work fronts to achieve normal productivity. Where work areas are fragmented, reduced in size, resequenced, delayed, partially released or otherwise made unavailable, Screed Works reserves the right to recover additional costs, including labour, supervision, remobilisation, plant, reduced productivity, extended preliminaries, out-of-hours working and acceleration measures.
7. Where areas have been quoted as ‘all available at once’ and are broken down into areas smaller than 100m², a day rate for labour will apply.
8. Any return visit, remobilisation, phased attendance or revisit to completed areas not caused by Screed Works shall constitute a variation and be chargeable.
9. Unless otherwise stated, no allowance has been made for scabbling (mechanical keying of the substrate).
10. An electric 110V or petrol-engine power-float may be used internally where there is sufficient ventilation to comply with health and safety regulations.
11. Where cost-driven material options are selected, the Client accepts the associated performance limitations and risks inherent to those materials.
12. Quotations are based on the screed depths, build-ups, drawings and information available at the time of pricing. Where actual depths, levels, quantities or build-ups differ from those assumed, Screed Works reserves the right to adjust the contract sum accordingly. Final quantities may be measured on completion.
Delivery of materials
13. The site must be able to receive deliveries on 20-tonne articulated vehicles unless otherwise arranged.
14. Unless previously agreed and included in the quotation, the Main Contractor/Client is responsible for taking delivery of all materials and ensuring they are placed in the required position (including hand-balling inside if necessary).
15. The Main Contractor/Client must ensure the site is ready to receive deliveries a minimum of two days prior to works commencing.
16. The Main Contractor/Client is responsible for the security and good condition of materials delivered to site. Screed Works Ltd is not liable for any damage caused to materials after delivery. We strongly advise that loose sand is covered by a tarpaulin to protect it from rain, as overly wet sand may be unusable for screeding.
17. We will carefully manage your deliveries by liaising between you and the relevant suppliers; please provide as much information as possible on your Job Quote Acceptance Form. Failure to provide important information or to make the necessary preparations for receiving materials may result in delays and/or additional costs. Screed Works is not liable for the removal of excess materials left on site.
18. Screed Works Ltd reserves the right to use alternative branded products of the same specification if the specified product is unavailable.
19. To prevent schedule implications and the risk of running out of materials part-way through a job, Screed Works Ltd may order up to 10% extra materials. All materials left over at the end of a job are the property and responsibility of the Client.
20. Final material quantities shall be based on actual site conditions and completed measurements. Any increase in quantities arising from revised dimensions, design changes, build-up changes or site conditions shall constitute a variation.
21. Upon acceptance of your quote, the material prices at the time of quoting will remain fixed for two (2) months from the date of acceptance. In the event that the Client delays scheduling or completing the works beyond this period, any increase in the cost of materials or other related expenses will be borne solely by the Client.
22. The job must be brought to completion within the agreed timeframe. Failure to do so may result in additional costs, for which the Client will be liable.
Customer responsibilities
23. The Customer is responsible for ensuring that all materials provided for the installation are suitable for use, compatible with each other and meet the requirements of the project, and must follow the installation guidelines and recommendations of the product manufacturers. Screed Works Ltd is not responsible for any defects or failures arising from the use of unsuitable or incompatible materials, from incorrect management of the environment during the drying/curing process, or from the incorrect installation of materials by others. Any advice provided by Screed Works regarding the use or installation of materials is given in good faith but does not relieve the Customer of their responsibilities under this clause.
24. The Client acknowledges responsibility for the accuracy of all drawings, specifications, dimensions, setting-out information, levels and datums supplied to Screed Works. Screed Works shall not be liable for costs, delays or defects arising from inaccurate information supplied by others.
Site requirements
Screed Works Ltd are not the project’s designers or architects; we are the subcontractors responsible for installing the works based on the Client’s design and the architect’s specification. It is essential that the areas designated for works are pre-surveyed, signed off by the Client and prepared prior to commencement of works.
25. The following must be provided by the Main Contractor/Client:
1) Datums marked clearly on walls and approved by the Client or Principal Contractor prior to commencement. Screed Works accepts no responsibility for the accuracy of levels, dimensions, datums or setting-out information provided by others.
2) All work areas for screeding must be dry and clear of all debris, tools, scaffolding/access towers, and other trades and their materials (the same applies where we are installing insulation). Delays may incur additional costs.
3) 110V 16A and 32A power (if a forced-action mixer is to be used).
4) Lighting in all areas without adequate daylight.
5) A water supply within 20m of the pump or mixer location.
6) A skip for cement bags, packaging, excess-material clean-up and washout of our screed pump/mixer. Where no skip is provided, materials will be left clear to one side for the Client to dispose of, and we will be unable to leave the site clean and tidy. Screed Works is not liable for any excess materials left over post-installation.
7) All preparation works, unless otherwise stated in writing. The building environment must be suitable for the drying/curing process of the product(s) being installed. Floor preparation, including the placement of insulation and slip membranes, must be correctly fitted prior to our arrival, and the underfloor-heating pipes must be commissioned, filled and secured properly to allow the screed to be laid correctly. Preparation procedures must be complied with accordingly; otherwise the finished result could be affected. Screed Works does not accept responsibility should the finished result be compromised due to preparation procedures not being adhered to.
8) Any required shuttering (barriers), installed prior to our screeders arriving on site and adequate to fully protect drainage channels, finished surfaces, etc. For self-levelling screeds the shuttering must be able to contain the liquid. Screed Works cannot be held liable for incorrectly installed shuttering.
9) Adequate signage/barriers to prevent others from coming into contact with our pump, mixer, hose or other tools, including any protection of the general public on roads and footpaths.
10) Adequate protection against damage to all areas of material storage, screed-pump operation and the path of the hose. Take particular care of doors, doorframes, drywall and finished floors by covering with Correx or similar.
11) Onsite parking for Screed Works Ltd operatives and plant.
12) Any and all relevant permits required by local authorities for deliveries and screeding works.
13) Unless expressly stated otherwise, Screed Works accepts no responsibility for the design, condition, suitability, strength, moisture content or compliance of the substrate. Any remedial works required shall be treated as a variation.
Scheduling & delays
26. Cancellation or postponement of scheduled works by the Main Contractor/Client must be notified to Screed Works at least 2 full working days in advance, otherwise we reserve the right to charge up to £750+VAT. This fee will only be charged if we are unable to fill the scheduled day(s) with other work.
27. Where the progress of the works is delayed, interrupted, resequenced, prolonged or accelerated by events outside the reasonable control of Screed Works, Screed Works shall be entitled to an extension of time and to recover associated costs, including labour, supervision, preliminaries, plant, accommodation, travel, remobilisation and acceleration costs.
28. For any project located outside the United Kingdom, the Client acknowledges that all travel, accommodation, logistics and associated costs are recoverable should works not commence due to the project being delayed, postponed or cancelled for any reason outside the control of Screed Works. Once travel arrangements have been confirmed, the Client will be liable for any non-refundable expenses incurred, together with a daily stand-down rate plus VAT to cover labour allocation, up to a maximum of 5 days. Thereafter, continued delays may result in rescheduling at the discretion of Screed Works and subject to availability.
Our work
29. Screed Works will make every effort to complete the work within the time stated; however, we accept no liability for issues that arise causing delays due to force majeure. Please advise us of your project timeline so that we can work with you as effectively as possible.
30. Quotations are based on working hours between 07:00 and 17:00 Monday to Friday unless expressly stated otherwise. Any requirement for night working, weekend working, bank-holiday working, double shifts, out-of-hours attendance or programme acceleration shall be subject to additional cost.
31. Our screed is installed to an SR2 finish and is within 3mm tolerance of datums. An SR1 finish must be requested prior to quotation.
32. After completion, Screed Works Ltd can take no responsibility for the protection of the screed.
33. Where Original Portland Cement screed is specified, selected or installed without the use of an approved additive, the Client acknowledges that such screeds are inherently prone to shrinkage-related movement, including curling and cracking. Screed Works Ltd shall not be held liable for such effects, provided the screed has been installed in accordance with the agreed specification and industry standards.
34. Screed Works shall not be liable for damage, cracking, curling, debonding, shrinkage or movement arising from: substrate movement; structural movement; inadequate joints; thermal movement; loading by others; environmental conditions; or subsequent trades.
35. Any concerns, defects or alleged defects relating to the Works must be notified to Screed Works Ltd in writing within 48 hours of discovery and, in any event, before any third party undertakes investigation, testing, alteration, covering or remedial works. Failure to provide such notice shall invalidate any claim to the extent that Screed Works has been prejudiced in its ability to investigate the alleged defect.
36. Where Screed Works accepts liability for defective workmanship, or for defective materials supplied by Screed Works, its sole obligation shall be, at its option, to repair, replace or make good the affected area. Screed Works shall not be liable for consequential loss, delay costs, professional fees, third-party contractor costs, removal costs or remedial works undertaken without first providing Screed Works with a reasonable opportunity to inspect and rectify the alleged defect. No claim shall be valid where the affected area has been altered, covered, removed, repaired or otherwise interfered with prior to inspection by Screed Works.
Payment
37. Where works exceed 7 days from start to final completion, whether scheduled or not, periodic payments will apply.
38. No set-off, withholding, contra charge, deduction or back charge shall be made against any invoice unless expressly agreed in writing by a Director of Screed Works Ltd prior to such deduction being made.
39. No CIS deductions apply to invoices; Screed Works Ltd is on HMRC’s Gross Scheme for CIS.
40. Screed Works charges in full for all pallets delivered to site until full account has been made upon their collection, after which a refund is given.
41. We reserve the right to charge in full for aborted materials and an aborted-visit fee of £975+VAT where we are unable to complete work on site for reasons outside of our control, including: cancellation by the Main Contractor or Client less than 2 full working days before work is due to commence; site access issues; unsuitable or unsafe site conditions; incomplete preparation by the Main Contractor or Client; or materials missing or turned away by the Main Contractor or Client.
42. Variations may arise from instructions, requests, drawings, emails, WhatsApp messages, revised programmes, meeting minutes, site instructions or conduct indicating acceptance of additional works. Payment shall be due irrespective of whether a formal variation order has been issued.
43. Site records maintained by Screed Works, including photographs, labour records, timesheets, delivery records, programme records, emails, WhatsApp messages and signed site documentation, shall constitute evidence of events, quantities and instructions unless proven otherwise.
44. In addition to any contractual remedies, Screed Works reserves the right to recover statutory interest, statutory compensation and reasonable debt-recovery costs pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.
Priority of terms
45. These Terms and Conditions apply in full to all works undertaken for Main Contractors, Principal Contractors, Developers, Retail Fit-Out Contractors, Commercial Clients and Property Companies, and shall take precedence over any conflicting terms contained in a purchase order, subcontract order or similar document. Our quotation is submitted as a qualified tender and is open for acceptance only on the basis that these Terms and Conditions apply. Acceptance of our quotation, the issue of any order, or permitting Screed Works Ltd to commence the Works, constitutes acceptance of these Terms and Conditions as an express condition of contract. Where the Works are carried out under a JCT, other standard-form or bespoke sub-contract, these Terms and Conditions are to be incorporated into that sub-contract, and any term inconsistent with them shall not apply unless expressly agreed in writing by a Director of Screed Works Ltd.
Limitation of liability
46. The aggregate liability of Screed Works arising from any contract shall not exceed the total contract sum paid or payable to Screed Works under that contract.
47. Under no circumstances shall Screed Works be liable for: loss of profit; loss of revenue; loss of opportunity; business interruption; consequential loss; indirect loss; or losses arising from delay to subsequent trades or to project completion dates.
Entire agreement
48. These Terms and Conditions, together with the quotation and any written variations, constitute the entire agreement between the parties. No verbal statement, representation, assurance or undertaking shall form part of the contract unless confirmed in writing by Screed Works Ltd.
Dispute resolution
49. Any dispute shall first be referred to senior representatives of the parties.
50. Failing resolution within 14 days, the dispute shall be referred to mediation.
51. Nothing in these Terms and Conditions shall prevent either party from exercising its statutory right to adjudication pursuant to the Housing Grants, Construction and Regeneration Act 1996.
52. The Courts of England and Wales shall have exclusive jurisdiction.
53. The prevailing party in any court proceedings relating to the recovery of unpaid sums shall be entitled to recover its reasonable legal costs and expenses to the fullest extent permitted by law.
Subcontracting
54. Screed Works Ltd may subcontract or delegate the performance of all or any part of the Works to one or more suitably competent subcontractors. Screed Works shall remain responsible for the Works so subcontracted, save as provided in clause 55.
55. Where a subcontractor, supplier or specialist is nominated, specified, directed or approved by the Client (or by the Principal Contractor, architect or other consultant acting on the Client’s behalf), Screed Works shall not be liable for the design, workmanship, materials, performance, delay or default of that party, and any such liability is excluded to the fullest extent permitted by law. Any additional cost, delay or remedial work arising from the acts or omissions of such a nominated or Client-approved party shall constitute a variation.
